...for the respondents The Court: Heard counsel appearing on behalf of the parties. Both counsel have submitted before this Court that they are willing to go for arbitration in this matter.

In light of the same, the Section 9 application is disposed of and the interim order passed in this matter on 3rd August, 2022 shall continue for a further period of eight weeks from date or until further order to be passed by the learned Arbitrator whichever is earlier. The parties have left the choice of the

Arbitrator to this Court and accordingly, I appoint Justice Aloke Chakrabarti, a former Judge of this Court, as sole Arbitrator to resolve the disputes between the parties. The appointment is subject to submission of declaration by the Arbitrator in terms of Section 12(1) in the form prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today.

Let this order be conveyed to the Arbitrator by the Registrar, Original Side forthwith.

AP No. 512 of 2022 is, accordingly, disposed of. The Section 11 application being AP No.862 of 2022 is also disposed of.
