Counsel for the defendant no.1 has filed affidavit of service showing that the defendant no.1 has requested the plaintiff to inspect the documents mentioned in the written statement but the counsel for the plaintiff refused to accept the notice and accordingly, the defendant has sent the notice to the plaintiff through mail and the same was duly received but neither the plaintiff nor the Advocate on Record of the plaintiff has come forward for inspection of the documents.

Let the affidavit of service filed by the defendant no.1 be kept with the record.

Considering the above, this Court finds that the plaintiff is not interested to proceed with the matter as in spite of direction for completion of inspection of documents, neither the plaintiff nor the Advocate on Record

of the plaintiff has come forward for inspection of documents or prayed for accommodation.

Accordingly, CS-COM/410/2024 [Old No. CS/180/2022] is dismissed for default.

Interim order, if any, stands vacated.
