...for the respondent no.2 The Court: Heard counsel appearing on behalf of the parties. This is an application under Section 11 read with Section 15(2) of the Arbitration and Conciliation Act, 1996. It appears from the minutes dated 5th October, 2021 that the Arbitrator has recused himself from hearing of the arbitration reference. In light of the same, parties have requested this Court to appoint an Arbitrator.

In view of the above, Mr. Dhirendra Nath Sharma, Advocate, (M. No.9830266167), is appointed as Arbitrator. The appointment is subject to submission of declaration by the Arbitrator in terms of Section 12(1) in the form

prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today.

Let this order be conveyed to the Arbitrator by the Registrar, Original Side forthwith.

Since no affidavits have been used by the parties, the allegations made in the petition are deemed to be denied and disputed. AP/558/2021 is, accordingly, disposed of.
