The Court : The parties before the Court being five plaintiffs and the sole defendant have agreed to settle their disputes by way of an Agreement for Settlement dated 15th February, 2021 by which the parties intend to submit the Agreement for Settlement before this Court in respect of the partition suit being CS 263 of 2018 for disposal of the suit. The Agreement sets out the condition by which the parties would have to act and clause 7 of the Agreement records that both the parties have agreed to withdraw all allegations made against each other and abide by the Terms of Settlement as well as Terms of Condition of the partition deed (clause 10).

All the parties are represented before the Court today.

Upon perusing the Agreement for Settlement, which is found to be in accordance with law, this Court is of the view that CS 263 of 2018 may be decreed in accordance with the said Agreement which is made part of records. CS 263 of 2018 is accordingly decreed in terms of the Agreement for Settlement dated 15th February, 2021.

Interim orders, if any, shall stand vacated and all connected applications shall stand disposed of by this order. The affidavit-of-service is kept on record.
