The Court: Supplementary affidavit filed contains a certified copy of the purchase order.

There is no dispute with regard to the existence of the said purchase order. Accordingly, I am of the view that the arbitration clause at paragraph 6 of the General Terms and Conditions attached to the purchase order is required to be acted upon.

Accordingly, Mr. Richit Lakhmani, Advocate Mob. No. 9231826568, is appointed as the sole Arbitrator to resolve the disputes between the parties.

The appointment is subject to submission of declaration by the Arbitrator in terms of Section 12(1) in the form prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today. Let this order be conveyed to the Arbitrator by the Registrar, Original Side forthwith.

AP/520/2022 is accordingly, disposed of.
