The Court : Mr. Kuldip Mallik, learned Advocate appears for the petitioner and Mr. Uttiyo Mallick, learned Advocate appears for the defendant. The parties have filed the Terms of Settlement entered between them dated 2nd April, 2024 wherein the dispute between the parties has been settled as the defendant has paid an amount of Rs.22,00,000/- by way of demand draft in the name of the plaintiff and the plaintiff has accepted the said amount being the full and final settlement. It is find from the plaint that the principal claim of the plaintiff is Rs.26,81,278/- and with interest the plaintiff has claimed an amount of Rs.49,86,649/- but now during the pendency of the suit the parties have settled their disputes for a total sum of Rs.22,00,000/- by executing the Terms of Settlement as full and final settlement.

In view of the Terms of Settlement filed by the parties, the suit is disposed of by making the Terms of Settlement dated 2nd April, 2024 as part of decree. The Department is directed to draw the decree by making the Terms of Settlement as part of the decree.

Accordingly, CS/181/2022 is disposed of.

Consequently, all applications are also disposed of. (KRISHNA RAO, J.) mg
