1. The matter relates to approval of appointment of the petitioner in the Scottish Church Collegiate School.

2. From the documents annexed to the writ petition, it appears that vide communication dated 28th March, 2023 the District Inspector of Schools (S.E.), Kolkata requested the School authority to submit formal proposal for approval of appointment along with all relevant papers/documents of the incumbent.

3. In furtherance thereof, the School forwarded all papers of the incumbent to the District Inspector of Schools (S.E.), Kolkata in May, 2023. Till date, there is no response to the same.

4. Learned advocate representing the State respondents seeks time to take steps in the matter.

5. Upon hearing the parties, it appears that more than two years have elapsed from the date the School forwarded all papers relating to approval of appointment of the petitioner to the District Inspector of Schools (S.E.), Kolkata. The District Inspector of Schools (S.E.), Kolkata ought to have taken immediate steps on receiving the documents from

the School authority to consider the same in accordance with law and to pass necessary order.

6. Had there been any discrepancy in the papers forwarded, the same ought to have been made to known to the School authority immediately for taking necessary remedial steps. The same has not been done till date.

7. In view of the above, the instant writ petition stands disposed of by directing the District Inspector of Schools (S.E.), Kolkata to take necessary steps on the documents forwarded by the School authority regarding approval of appointment of the petitioner.

8. The fate of the approval shall be made known to the School and the petitioner positively within a period of eight weeks from the date of communication of this order. If any further document is wanting, the same shall be intimated to the School authority immediately on the receipt of this order.

9. Learned advocate for the petitioner is directed to forward all relevant documents in connection with the approval of appointment of the petitioner to the District Inspector of Schools (S.E.), Kolkata at the time of communicating the order of the Court.

10. It will be open for the District Inspector of Schools (S.E.), Kolkata to call for a hearing of the parties prior to passing final order in the matter, if required.

11. Writ petition stands disposed of.

12. Affidavit of service filed in Court today is taken on record.

13. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all legal formalities. (AMRITA SINHA, J.) nm
