1. The petitioners are aggrieved by the communication dated 15th October, 2025, issued by the authorized officer/ Chief Manager of the Indian Bank, requesting the petitioners to submit a Court issued Succession Certificate supporting the claim for legal heirs for registration of sale certificate.
2. It has been alleged that the said communication has been issued contrary to the direction passed by the Court on 1st July, 2025 in the writ petition.
3. On a perusal of the order dated 1st July, 2025, it appears that the Senior Manager of the Indian Bank, being the respondent no. 3, was directed to take steps to consider and dispose of the representation made on behalf of the petitioners after giving reasonable opportunity of
hearing to the petitioners and all other necessary parties within a stipulated time period. The time period to comply the order passed by the Court has expired.
4. The petitioners allege that no opportunity of hearing was given prior to issuing the impugned communication dated 15th October, 2025.
5. On a perusal of the application for contempt, it appears that the same is not in proper form. The contemnor has not been impleaded by name.
6. The Court is not inclined to exercise jurisdiction in the contempt application.
7. It will be open for the petitioners to challenge the impugned communication dated 15th October, 2025, in accordance with law before the competent forum, if so advised.
8. CC/121/2025 is disposed of.
9. Urgent certified photocopies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (AMRITA SINHA, J.) sg.
