Report filed by the Bar Council of West Bengal is taken on record. 2.

It has been submitted that the petitioner is required to submit the document showing cancellation of his certificate of practise as Chartered Accountant.

Learned advocate for the petitioner has pointed out to annexure 'P-2' at page 17 of the writ petition which is a certificate issued by the Deputy Secretary of the Institute of the Chartered Accountants of India mentioning that the certificate of practice of the petitioner has been cancelled with effect from 26.04.2024.

The petitioner is yet to formally submit the aforesaid document before the Bar Council. It will be open for the petitioner to submit document(s)

evidencing cancellation of his certificate of practice including furnishing the gazette notification consequent thereto.

On receiving the said document from the petitioner, the Bar Council shall take steps for processing the application filed by the petitioner seeking enrolment. The norms and formalities required to be complied with by the petitioner shall be intimated to him. 6.

It is made clear that as the application filed by the petitioner is pending consideration before the authority and the same is yet to be formally disposed, Bar Council shall not seek for fresh application to be filed by the petitioner. In the event a fresh application is required to be filed, Bar Council shall refund the application fee that has been deposited by the petitioner as the earlier application could not be proceeded with because of non furnishing of document by the petitioner.
