The Court:- The affidavit of compliance filed by the respondent is taken on record.

Learned counsel for the petitioner submits that the arbitral tribunal has been constituted. With the consent of both parties, the present application under Section 9 shall be treated as an application under Section 17 before the learned Sole Arbitrator.

Learned counsel for the respondent submits that all his contentions shall remain open. The learned Sole Arbitrator shall decide the application under Section 17 independently and without being influenced by any observations made by this Court in its earlier orders.

The present petition stands disposed of in the above terms.

The interim order granted earlier by this Court is extended for a further period of four weeks.

The Registry shall furnish certified copies of the pleadings, as and when applied for by the parties, expeditiously.
