The Court : This is an application under Section 9 of the Arbitration and Conciliation Act, 1996. It is submitted on behalf of the petitioner that pursuant to the terms of settlement entered into by and between the parties the petitioner prays for an opportunity to withdraw the amounts lying with the Registrar, Original Side, High Court, Calcutta.

In an appeal under Section 37 of the Arbitration and Conciliation Act, 1996, the respondents had been directed to deposit a sum of Rs.38,13,559/- with the Registrar, Original Side, High Court, Calcutta. Thereafter, the parties have entered into a Terms of Settlement which has culminated in a final award dated 15th November, 2021.

In view of the final award, the petitioner now prays for opportunity for releasing of the sums lying with the Registrar, Original Side, High Court, Calcutta.

The respondents are represented and do not object to the prayer for release of the sums lying with the Registrar, Original Side, High Court, Calcutta. In view of the aforesaid, there shall be an order in terms of prayer (a) of the Notice of Motion.

AP No. 568 of 2021 stands disposed of.
