The Court :- This is an application for grant of probate filed after about 21 years from the date of death of the testator. Although, the explanation for the delay is not convincing yet the probate is granted as none of the heirs in intestacy have objected to the grant, on the contrary have filed their consent affidavit for the grant be issued.

The Will has been proved in common form by the affidavit of the attesting witness.

Considering the view of the department upon complete scrutiny, the application for grant of probate is allowed by granting order in terms of prayer (a) of the petition.
