...for the respondents The Court: Learned counsel appearing for the appellants seeks to withdraw the appeal on the ground that the appeal has become infructuous in view of the orders passed by the learned Arbitrator pursuant to an application made by the respondents (claimants in the arbitration) under Section 17 of the 1996 Act.

The records show that the appellants had sought time to keep the matter beyond the October vacation. This is recorded in the order dated 9th October, 2023.

Learned counsel appearing for the appellants submits that the appellants do not wish to proceed with the appeal since the Arbitrator has already appointed a Receiver to carry out an inventory pursuant to which the Receiver has already submitted his report.

APOT/287/2023 along with all connected applications are disposed of as having become infructuous.
