The Court: The learned Advocate for the respondent who is present in Court, raises the question of maintainability of the application. It is submitted that the seat of arbitration is in Delhi as per the agreement and the arbitration proceeding is being carried on Delhi.

The petitioner prays for termination of mandate of the learned Arbitrator and appointment of a substitute arbitrator.

Despite several calls, none appears for the petitioner.
