...for the petitioner The Court: Affidavit of service is taken on record. This is the second service upon the respondent. The affidavit of service indicates that the respondent was served at the last known address. Despite service, none appears. This Court has no other option but to proceed in his absence. The minutes dated July 8, 2024 records that the learned advocate had submitted that he had no further instruction to appear for the respondent. The minutes of the 10th sitting of the arbitration held on July 23, 2024 records that the respondent appeared in person. Under such circumstances, the respondent has been served twice.

This is an application for extension of the mandate of the learned Arbitrator which expired on November 20, 2024. It is submitted that arguments are complete and the award is awaited.

Considering the advanced stage of the proceeding, this Court deems it fit to extend the mandate of the learned Arbitrator by a further period of three months from the date of communication of this order, to enable the learned Arbitrator to make and publish his award.

A copy of this order shall be served upon the respondent by the petitioner. AP-COM/949/2024 is, accordingly, disposed of. (SHAMPA SARKAR, J.) B.Pal
