The Court:- The present application has been filed by the petitioner under Section 29A of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the arbitral proceedings and for publication of the arbitral award.

This Court, vide order dated 16.09.2022, appointed a sole arbitrator to adjudicate disputes between the parties.

The pleadings were completed on May 2023. The petitioner had refused to give consent to the extension of the mandate and hence the respondent had approached this Court and vide order dated 02.09.2024, the mandate was extended by six months.

It is contended by the learned counsel for the petitioner that the mandate has expired on 01.03.2025 and hence the petitioner is seeking extension of the

mandate of the arbitral tribunal for conclusion of the arbitral proceedings and publication of the award. It is further stated that the matter is at the stage of publication of the award.

Learned counsel for the respondent states that he has no objection to the present application. He states that the mandate of the tribunal had expired on 01.03.2025.

This Court notes that the tribunal has conducted more than 24 sittings and the matter is presently at the stage of publication of the award. Upon consideration of the entire record, this Court is satisfied that there has been no undue or unwarranted delay on the part of the learned arbitrator in conducting the proceedings. Having regard to the stage of the proceeding and in the interest of justice, the mandate of the learned sole arbitrator is further extended for a period of six months from today. The learned sole arbitrator is requested to make all reasonable endeavours to publish the award within the extended time period.
