The Court: On December 17, 2025, this matter had been listed. Since nobody appeared for the respondent Bank, a Co-ordinate Bench had directed fresh notice to be served on the Bank. That has been done. A copy of the receipted notice filed in Court today be kept with the records. In spite of receipt of notice, nobody has appeared for the Bank. This is an application for condonation of delay of 1404 days in presenting the appeal. Although the delay is substantial, we are satisfied with the explanation furnished for the delay. The delay is condoned.

GA/1/2025 is disposed of.

This appeal is directed against an order dated December 24, 2021, passed by a Learned Judge of this Court in the appellant's writ petition being WPO/1548/2021. By that order, the writ petition was dismissed. The appellant says that he is not challenging the order as such. He is aggrieved with an observation made in paragraph 2 of the order to the effect that he is the main person behind the corporate debtor, M/s. JVL Agro Industries Limited.

The appellant says that it is not correct to describe him as the main person behind the corporate debtor. Learned counsel for the appellant draws our attention to the annual report of the company for the year 201718 where the appellant is shown as a whole-time Director. The Chairman is one Mr. D.N. Jhunjhunwala and the Managing Director and CEO is Mr. S.N. Jhunjhunwala.

Hence, it appears that the appellant may not be the main person behind the corporate debtor. Recording the same, we are disposing of the appeal.
