1. Mr. S. Ghosh, learned Advocate, is appearing for the petitioner.

2. The petitioner has filed the present application for grant of Letters of Administration of the properties and credits of the deceased, Soumo Bose who died on 13th December, 2022 leaving behind his mother, wife and two sons. The wife of the deceased is the petitioner before this Court and other three legal heirs i.e. the mother and both the sons have filed their affidavits of consent stating that they have no objection for grant of Letters of Administration to the petitioner to the estate of the deceased.

3. Considered the submission made by the counsel for the petitioner. Perused the application, death certificate of the deceased and the affidavits of the legal heirs of the deceased.

4. This Court finds that the legal heirs of the deceased have categorically stated that they have no objection for grant of Letters of Administration to the petitioner to the estate of the deceased.

5. Considering the above, this Court finds that there is no impediment for grant of Letters of Administration to the petitioner without the Will throughout the State of West Bengal.

6. Accordingly, the department is directed to issue Letters of Administration to the properties and credits of the deceased throughout the State of West Bengal to the petitioner subject to furnishing personal bond of Rs.15,00,000/- with two sureties.

7. PLA/418/2024 is disposed of.

8. The department is directed not to draw up and complete the order.
