...for the petitioner The Court: This is an application for extension of the Arbitrator's mandate under Section 29A of the 1996 Act. According to learned counsel appearing for the petitioner the mandate admittedly expired on 31st August, 2023 after an extension of six months under Section 23A(3) from 1st March, 2023. Counsel submits that Advocate-on-Record of the respondent retired from the matter on 6th July, 2023 which would be reflected from the Minutes dated 5th July, 2023.

The affidavit of service is placed before the Court but no one appears for the respondent. The petitioner is the claimant. Counsel submits that the petitioner's witness was being examined as on the date of filing of the present application. The present application was filed on 25th August, 2023.

Since the application was filed during the subsistence of the mandate and the timelines under Section 29A are in order, AP/612/2023 is accordingly allowed and disposed of by extending the learned Arbitrator's mandate for a period of four months from 31st August, 2023.
