The Court: This is an application for execution of an award. It is submitted that despite an order dated 26 July, 2023, the awarddebtor, a government company has not taken any steps to settle the matter. In such circumstances, both the parties are directed to take steps to see whether without prejudice to their respective rights and contentions the matter can be amicably resolved to put a quietus to this litigation which has been pending for more than two decades.

In the meantime, the earlier order of injunction in terms of prayer (f) stands confirmed.

The award-holder is also directed to keep the fixed deposit renewed till disposal of the application under Section 34 of the Arbitration & Conciliation Act, 1996 or until further orders of Court.

With the aforesaid directions, EC/311/2011 stands disposed of. All other points are left open to be adjudicated at the appropriate stage.

The disposal of this application shall not act as a bar to either of the parties raising all points available to them in accordance with law. Liberty is granted to the award-holder to take back the original award filed in this proceeding after replacing the same with a photocopy thereof. (RAVI KRISHAN KAPUR, J.) s.pal
