...for the respondent The Court: There is no scope for any injunction at this stage as the finance company has already sold the vehicle which was hypothecated to it at the time of advancing loan to the petitioner. Admittedly, the petitioner as the borrower failed to pay the dues on time, although the petitioner submits that only two instalments had fallen due. The finance company submits that there was substantial default and the sale took place upon intimating the petitioner about such sale at the recorded address of the petitioner.

Accordingly, no useful purpose would be served by keeping this application pending. The application is, accordingly, disposed of without any orders. Petitioner is at liberty to take appropriate steps as permitted by law. A copy of the agreement between the petitioner and the borrower has been served in Court upon the learned Advocate for the petitioner. (SHAMPA SARKAR, J.) B.Pal
