4. Heard the learned Counsel for the parties and perused the memorandum of understanding.

5. CS/173/2023 is dismissed as infructuous.

6. Let the memorandum of understanding be kept with the record.

7. Accordingly, connected applications are also disposed of.

8. It is submitted by the learned Counsel for the parties, that the civil suit is also pending before the learned City Civil Court.

9. The petitioner is at liberty to take appropriate steps before the Court for withdrawal of the suit.
