Though, by this writ petition the petitioner seeks to challenge the order of demolition dated 23rd July 2025 passed by the Special Officer (Building), Kolkata Municipal Corporation in connection with the demolition case no.06-D/VIII/25-26 with regard to the 5th floor flat being flat no.5A of premises no.2, Panditiya Place, Kolkata, however, the learned senior advocate for the petitioner by placing before this Court an e-mail communication dated 19th June 2026 would submit that he has received instruction from the petitioner that the petitioner does not wish to proceed further with the instant writ petition.

Accordingly by retaining the said e-mail communication on record, the writ petition and the connected application stand dismissed for non-prosecution.

Interim orders, if any, passed stand vacated. 4.

Having regard thereto, there shall be no impediment now for the municipality to enforce the demolition order in accordance with law, unless, there be any impediment in implementing the same. (RAJA BASU CHOWDHURY, J.) R. Bose
