It is submitted on behalf of the judgment debtor that by an order dated 13th August, 2013, the Hon'ble Division Bench had pleased to set aside the ex parte decree dated 1st August, 2012 which is sought to be executed. In such circumstances, the instant application has become infructuous and no purpose would be served in keeping the same pending. In view of submissions made on behalf of the judgment debtor and in view of the absence of the decree holder, EC/332/2012 stands dismissed for default. Interim orders, if any, stand vacated.
