Appearance:- Mr. Shounak Mukhopadhyay, Adv.

Ms. Anuradha Poddar, Adv.

...for petitioner.

Mr. Swarajit Dey, Adv.

Mr. Saptarshi Kar, Adv.

...for respondent.

The Court:-The petitioner has preferred the present application under Section 29A of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the arbitral tribunal for completion of the arbitral proceedings and publication of the arbitral award. Learned counsel for the petitioner states that this Court vide order dated 11thFebruary, 2021 had appointed the sole arbitrator to adjudicate the dispute between the parties. He further states that this Court vide order dated 1stApril, 2024 in AP-COM/55/2024 extended the mandate of the arbitral tribunal till 31.12.2024. Thereafter this Court again vide order dated 17.12.2024 in AP (COM) No. 1044 of 2024 had extended the mandate of the arbitral tribunal for one year from the date of communication of the said order.

It is submitted by the learned counsel for the petitioner that the matter is presently at the stage of final arguments. Learned counsel for the respondent states that he has no objection to the extension of the mandate of the arbitral tribunal. Upon consideration of the materials on record, this Court is satisfied that there has been no undue and unwarranted delay on the part of the learned sole arbitrator to conclude the proceedings. Having regard to the advanced stage of the arbitral proceedings and in the interest of justice, the mandate of the arbitral tribunal is further extended for a period of eight months from today. The learned sole arbitrator is requested to make all reasonable endeavours to conclude the arbitral proceedings and publish the award within the extended time period.

With the above observations, the present application stands disposed of. (GAURANG KANTH, J.) R. D. Barua
