The Court:- Affidavit of service filed today in Court is taken on record. This contempt application arises out of an alleged violation of the an order dated 27th April, 2022 passed in WPO No. 1551 of 2022, inter alia, on the ground of failure on the part of the alleged contemnor to dispose of the petitioner's application for compassionate appointment as directed by the order under contempt.

It is submitted that the application for compassionate appointment made by the petitioner has been considered and rejected by an order dated 12th July, 2022 passed by the alleged contemnor. In view of the aforesaid, since the order under contempt has been complied with by considering the application for compassionate appointment, a new cause of action, if any, has accrued in favour of the petitioner with the rejection of the application which cannot be gone into in the instant contempt petition.

In the aforesaid facts and circumstances, the contempt proceedings cannot be any further proceeded with. The contempt proceedings is, therefore, dropped and the contempt application is disposed of recording the aforesaid and without any further orders. (ARINDAM MUKHERJEE, J.) sb/
