The Court :- This is an application for grant of probate of the last Will and Testament dated 1st December, 2013 left behind by the abovenamed deceased.

The deceased was survived by his widow, two minor daughters and the mother. The mother of the testator has consented to the grant. The widow who is also the executrix and the applicant has given consent on behalf of the two minor daughters of the testator.

The widow, namely, Moumita Bhaduri has filed an affidavit affirmed on 15th May, 2023 which is taken on record.

It will appear from the said affidavit that the deponent/executrix has given an undertaking that in the event she sells the properties and assets bequeathed under the Will pursuant to obtaining grant she shall secure the respective share of her minor daughters by way of fixed deposits. In view of the declaration and undertaking given by the executrix who is also the widow of the deceased and the natural guardian of the two minor

daughters of the deceased, probate is granted by allowing the application in terms of prayer (a).

The petition for grant of probate stands disposed of, accordingly. (ARINDAM MUKHERJEE, J.) snn
