The Court: This is an appeal under Section 37 of the Arbitration and Conciliation Act, 1996. On behalf of the respondent, it is submitted by the respondent that a final award dated 3 December, 2022 has been passed by the Arbitral Tribunal.

On behalf of the petitioner, it is submitted that no copy of the award has ever been served on the respondent. This submission is disputed by the respondent. In view of the above and primarily on the ground of a final award having been passed, nothing survives in this application, APOT/315/2023 stands dismissed.

The connected interlocutory application being GA/1/2023 also stands disposed of.
