The Court: Heard counsel appearing on behalf of the parties. This is a Section 14 application for recording the defacto termination of the mandate of the learned sole Arbitrator, namely, Mr. Syama Prosad Sarkar (since deceased) and for appointment of a new Arbitrator in his place and stead. In view of the above, with consent of both parties, Mr. Utpal Bose, Senior Advocate, Bar Library Club, is appointed as Arbitrator. The appointment is

subject to submission of declaration by the Arbitrator in terms of Section 12(1) in the form prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today. Let this order be conveyed to the Arbitrator by the Registrar, Original Side forthwith.

Accordingly, AP 617 of 2022 is disposed of.
