...for the petitioner The Court: In spite of service, none appeared for the respondents on the earlier occasion. The Court had directed paper publication. Under such circumstances, insertion in two widely circulated dailies, one in English and one in Bengali have been made.

An affidavit of service is filed today, in support of such paper publication. The learned Arbitrator was appointed by this Court. It appears that none represented the respondents before the learned Arbitrator on the last sitting, that is, on November 26, 2024.

Under such circumstances, this Court is of the view that the arbitral proceeding must continue and be reached to its logical conclusion. The mandate of the learned Arbitrator expired on December 6, 2024. The witness action is to begin.

Considering the progress made before the learned Arbitrator, this Court deems it fit to extend the mandate of the learned Arbitrator by a further period of one year from the date of communication of this order, to enable the learned Arbitrator to make and publish the award.
