...for the respondent The Court:- The Court:- Learned counsel appearing for the parties agree that a new Arbitrator may be appointed in the present application. The records shown to the Court reveal that the Arbitrator first decided to withdraw the application and subsequently entertained an application filed by the respondent under Section 33 of the 1996 Act by recalling the earlier order. The respondent before the Court is the claimant in the arbitration. The Court hence proceeds to appoint an Arbitrator in place and stead of the erstwhile Arbitrator.

AP/690/2023 is accordingly allowed and disposed of by appointing Mr. Subrata Talukdar, former Judge of this Court to act as the Arbitrator to resolve the disputes and differences between the parties subject to the learned

Arbitrator communicating his consent in the prescribed form to the Registrar, Original Side of this Court within three weeks from date. The Advocate-on-Record of the petitioner will communicate this order on the Arbitrator by 24th November, 2023 along with the relevant details of the contact person.

The erstwhile Arbitrator is requested to send all the records to the new Arbitrator by 30th November, 2023.
