...for the respondent The Court: This is an application for appointment of a learned Arbitrator on the strength that the Dispute Resolution clauses contained in four agreements entered into by and between the parties. Two of the agreements are third party logistic agreements and the other two are transport agreements. Disputes arose between the parties. The petitioner issued a notice invoking arbitration dated September 17, 2024. The respondent also invoked arbitration by a letter dated August 7, 2024. Both parties have indicated in their notices that there should be a composite reference in respect of all the four agreements, as the issues involved and points to be adjudicated are similar. The issues are interlinked as will be

available from the notices invoking arbitration. It is also accepted by the parties that there is a live dispute.

Under such circumstances, this application being AP-COM/207/2024 is disposed of by referring the disputes to the learned Sole Arbitrator. Accordingly, the Court appoints Mr. Rohit Banerjee, learned Advocate (Mob. No.9163891670), as the Sole Arbitrator, to arbitrate the dispute. This appointment is subject to compliance of Section 12 of the Arbitration and Conciliation Act, 1996. The learned Sole Arbitrator shall fix his own remuneration as per the Schedule of the Act.
