RE: GA-COM 1 of 2025:- GA-COM 1 of 2025 is an application for restoration of AP-COM 1054 of 2024.

Considering the submissions and the averments in paragraphs 4 to 6, this Court is satisfied that the petitioner was prevented by sufficient cause from attending the Court when the application was called on and dismissed for default.

GA-COM 1 of 2025 is thus, allowed. AP-COM 1054 of 2024 is restored to its original file and number.

RE: AP-COM 1054 of 2024:- AP-COM 1054 of 2024 is taken up here and now at the request of the parties. This is an application for extension of the mandate of the learned Arbitrator.

Mr. Banerjee, learned advocate for the respondent, submits that the learned Arbitrator Mr. Pijush Kanti Roy, Senior Advocate of the Supreme Court has recused himself for health reasons. Communication has been received from the Assistant Registrar of the High Court at Calcutta in this regard. In view of the recusal, the prayer for extension of the mandate of the learned Arbitrator becomes infructuous. Liberty is granted to the petitioner to file an appropriate application for appointment of an Arbitrator, in view of such recusal / withdrawal by the learned Arbitrator. Affidavit in reply is taken on record.
