The Court: It is informed to the Court that the learned Arbitrator had recused on December 10, 2024. This is an appeal arising out of an Order dated October 24, 2024 passed by the learned Arbitrator. By Order dated January 22, 2025, this Court had stayed the operation of the order impugned with reasons. The Court was primarily of the view that an unilaterally appointed Arbitrator, without balancing the convenience and inconvenience and without weighing the irreparable loss and injury that would be caused to the appellant, passed an order of injunction to the effect that there shall be a debit freeze on the account of the petitioner maintained with the Axis Bank, Sector 9 Gurgaon, Haryana, for a sum of Rs. 20,47,178.30.

Under such circumstances, and in view of the recusal of the learned Arbitrator, the order dated October 24, 2024 passed by the learned Arbitrator, is set aside.

The appeal and application are disposed of.
