1. Although, the writ petition has been filed for a direction upon the municipality to take steps on the basis of the representation made by the petitioners as regards the alleged illegal construction carried out at the premises no.5, Bijoy Mukherjee Lane, Kolkata - 700 025, Mr. Banerjee, learned Advocate for the municipality, on the other hand, would submit that proceeding has already been initiated by the Corporation.

2. Heard learned Advocates representing the respective parties. Since the municipality while acting on the petitioners' complaint has already initiated proceeding to arrest illegal construction by issuing notice under Section 401 of the Kolkata Municipal Act, 1980, there is no necessity to pass any further order.

3. Let a copy of the report prepared by the municipality as filed by Mr. Banerjee in Court today be taken on record.

4. It is expected that the municipality will bring the proceeding initiated by them to a logical conclusion as expeditiously as possible preferably within a period of 12 weeks from the date of communication of this order.
