..for KMC The Court: The petitioner contends that the tax bill issued for Premises No. P-96A, Hemanta Mukhopadhyay Sarani, Kolkata-29 should be apportioned between him, as the landlord, and Respondent No. 5, his licensee.

On the other hand, Mr. Biswajit Mukherjee, the learned Advocate appearing on behalf of the Corporation, argues that under Section 230 of the Kolkata Municipal Corporation Act, 1980, the Corporation is authorised to proceed against the landlord for the recovery of the unpaid taxes. However, this Court does not find it necessary to examine the merits of the dispute at this juncture.

The petitioner has submitted a representation to the Assessor Collector (South) on October 7, 2024, seeking redress for his grievance. In light of this, I direct the Assessor Collector (South), Kolkata Municipal Corporation, to consider the representation dated October 7, 2024, within one month from the date of communication of this order. While disposing of the representation, the Assessor Collector (South) shall afford an opportunity for a hearing to both the petitioner and Respondent No. 5.

WPO/1217/2024 is disposed of.
