...for the defendant The Court: Learned lawyer appearing for the defendant submits that in compliance with the Court's direction dated 20th June, 2022 he served notice upon the Advocate-on-Record of the plaintiffs intimating him that the matter will appear in the list today for framing of issues. A photocopy of the notice filed by the defendant be kept on record. It appears that when the suit appeared before this Court on 20th June, 2022, none appeared for the plaintiffs.

After it was found that the defendant filed written statement on 10th August, 2015, the suit has been listed today for framing of issues. On call, none appears for the plaintiffs today also.

The conduct of the plaintiffs indicates that the plaintiffs are not interested to proceed with the suit. I feel that there is no justification to continue the suit any longer.
