Mr. Tapan Coomaar Dey, Ms. Shreya Chatterjee, Advs. ...for respondent. The Court :- Learned Counsel for the petitioner submits that the parties entered into a mutual settlement.

A copy of the Memorandum of Understanding for settlement is handed over in Court and is kept on record.

Learned Counsel for the respondent assures that the payments in terms of the settlement shall be made by tomorrow.

In such view of the matter, learned Counsel for the petitioner, on instruction, seeks to withdraw the application under Section 34 of the Arbitration & Conciliation Act, 1996.

Accordingly, AP 813 of 2023 is dismissed as withdrawn in terms of the above observations, keeping on record a copy of the Memorandum of Understanding for settlement filed today.

However, irrespective of the disposal of the matter, the department shall carry out the necessary corrections pursuant to the amendment effected to the cause title of the application within a fortnight from date. Liberty is given to the learned Advocate on record for the respondent to file his Vakalatnama and affidavit of competence in the department, which shall be treated to be the appearance of the respondent in the present matter. .
