The Court: Learned counsel for the respondent no.7 rightly points out that the cause of action of the present writ petition arose beyond the territorial jurisdiction of the Original Side of this Court and as such the matter ought to have been filed in the Appellate Side. Learned counsel also cites an unreported judgment of a co-ordinate Bench in Susmita Gayen versus The State of West Bengal & Ors. (WPO 119 of 2020) in support of his proposition. Accepting such proposition upon hearing learned counsel, let the matter go out of the list. The office is directed to carry out the necessary corrections in the classification of the matter within a week from date.
