...for respondent The Court :- This is an application for appointment of an arbitrator, on the demise of the erstwhile learned Arbitrator. The proceedings were near completion.

Learned Advocate for the respondent does not have any objection to the appointment of an arbitrator.

Considering the circumstances, AP-COM/1077/2024, is allowed. Hon'ble Justice Sanjib Banerjee, former Chief Justice of Madras and Meghalaya High Court, is appointed as the sole arbitrator, to arbitrate upon the disputes between the parties.

The learned Arbitrator shall comply with the provisions of Section 12 of the Arbitration and Conciliation Act, 1996. The learned Arbitrator

shall be at liberty to fix his remuneration as per the Schedule of the Arbitration and Conciliation Act, 1996.

The parties agree before the Court that, the learned Arbitrator may proceed from the stage of arguments. The parties are at liberty to take back the records from the office of the learned erstwhile Arbitrator or in the alternative, records may be reconstructed, subject to further directions by the learned arbitrator.
