..for the respondent The Court: The petitioner has preferred the present application under Section 29A of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the arbitral tribunal to conclude the arbitral proceedings and publish the arbitral award.
Learned Counsel for the petitioner submits that this Court vide order dated 22.12.2020 appointed a sole arbitrator to adjudicate the disputes between the parties. The pleadings were completed on 14.06.2021. This Court vide order dated 18.11.2024 extended the mandate of the arbitral tribunal for a period of one year, which stood expired on 17.11.2025. Learned Counsel for the respondent states that he has no objection to the extension of the mandate of the arbitral tribunal. It is further contended that the arbitral tribunal has conducted more than 53 sittings and the matter is presently at the stage of recording of evidence.
Learned Counsel for the petitioner submits that the matter involves voluminous documents and that, despite the best efforts of the arbitral tribunal, the proceedings could not be completed within the extended time period.
Upon consideration of the submissions of the parties and the materials placed on record, this Court is satisfied that there has been no undue or unwarranted delay on the part of the learned sole arbitrator in conducting the proceedings.
Having regard to the advanced stage of the arbitration and in the interest of justice, the mandate of the learned sole arbitrator is extended further for a period of one year from today.
It is requested that the learned sole arbitrator will make all reasonable endeavours to conclude the arbitral proceedings and publish the arbitral award within the extended time period.
With the aforesaid observations, the present application stands disposed of.
