...for the plaintiff The Court: In terms of the order dated 26th June, 2024, the office has placed the record of CS/226/2022.

This Court has perused the plaint.

Counsel for the plaintiff submits that the plaintiff had filed CS/226/2022 against one M. Payne but subsequent to filing of the suit, the plaintiff came to know that the said defendant M. Payne had expired prior to filing of the case and accordingly the plaintiff prays for withdrawal of CS/226/2022.

In view of the submission made by the counsel for the plaintiff, CS/226/2022 is dismissed as withdrawn.

Now the plaintiff has filed the present suit being CS/14/2024 against one Cassandra Payne for eviction and recovery of mesne profit.

This Court finds that the plaintiff has not prayed for any leave from this Court. Accordingly, CS/14/2024 be placed before the learned Master for passing appropriate order.
