...for respondent no.5 The Court: The petitioner alleges that respondent no.6, his brother, is creating nuisance at the relevant premises by letting loose his dogs and also damaging the property by keeping a large number of earthen pots with plants on the roof of the building.

It appears that with the identical grievance, writ petitioner has filed an injunction application before the learned Judge, Bench-XII at City Civil Court, Calcutta in connection with Title Suit No. 323 of 2024. In that view of the matter, this writ petition is not maintainable. Accordingly, WPO/1225/2024 is dismissed.
