The Court: Mr. Ajay Krishna Chatterjee, learned senior advocate appearing for the respondents submits that the impugned judgement and order as modified on 18th October, 2023 has been operating for about 7 months now. In the meantime, the interlocutory application has become ready for hearing after exchange of affidavits. He submits that with the interim order as modified by this court, this appeal should be disposed of and the interlocutory court requested to dispose of the application before it. Mr. Dasgupta, learned advocate for the appellant, seeks a day's accommodation to take instruction in the matter.

This appeal along with the application is adjourned for the day and is to retain its position in the list.
