...for the respondent The Court: Learned counsel for the petitioner seeks to withdraw the present petition. The parties have consented to the appointment of Hon'ble Mr. Justice Jyotirmay Bhattacharya (Retired) as the sole Arbitrator to adjudicate the disputes between the parties.

Learned counsels appearing for the respective parties submit that they have obtained consent from their respective clients for appointment of Hon'ble Mr. Justice Jyotirmay Bhattacharya (Retired) as the sole Arbitrator. Learned counsels for the parties are at liberty to take appropriate steps and file appropriate proceedings before the learned sole Arbitrator. The learned sole Arbitrator shall be at liberty to fix his fees in accordance with the Fourth Schedule of the Arbitration and Conciliation Act, 1996.

Learned counsel for the petitioner shall be at liberty to move an appropriate application under Section 17 of the Arbitration and Conciliation Act before the learned sole Arbitrator which shall be decided independently on its own merit.

Learned counsel for the respondent shall also be at liberty to move an appropriate application under Section 16 of the Arbitration and Conciliation Act, 1996, to be decided by the learned sole Arbitrator, in accordance with law.
