...for the defendant The Court: Ms. Paulomi Dutta, learned counsel, is appearing for the defendant. None appears on behalf of the plaintiff. It is found from the record that the case was fixed on 18th November, 2023 but on the said date none appeared on behalf of the plaintiff and for the interest of justice, the case was adjourned and the parties were directed to complete the discovery and inspection of the documents and to file affidavit of admission and denial of documents and to exchange the suggested issues. Today when the matter is called, none appears on behalf of the plaintiff. Counsel for the defendant submits that she has tried to contact with the defendant but failed to contact the counsel for taking appropriate steps. Considering the submission made by the counsel for the plaintiff and after going through the record, this Court finds that the plaintiff is not interested to proceed with the suit.

Accordingly, CS/277/2010 is dismissed for default. Interim order, if any, stands vacated.
