The Court : It is submitted on behalf of the Registrar of Companies that there is no purpose in proceeding with the impugned notice and the same has become infructuous with the passage of time. Significantly, the impugned notice is dated as far back as on 1st September, 2016. In view of the submission made on behalf of the award-debtor, no further action shall be taken in respect of the impugned notice dated 1st September, 2023.

In view of the aforesaid, CP/917/2016 stands allowed. There shall be no order as to costs.

Needless to mention that the petitioners shall not be held guilty of any violation of under the provisions of section 209A(5) of the Companies Act, 1956.
