This application is for withdrawal of the suit based upon a communication dated 6th January, 2021 from one Pranab Kumar Maity to one Mr. V. V. V Sastry. The said communication in the form of an email advises the plaintiff's advocate to withdraw the Civil Suit and not proceed any further in the matter.

It is submitted on behalf of the plaintiff that Mr. Pranab Kumar Maity is the company Secretary of the plaintiff and General Manager Legal, which would appear from a copy of the board resolution of the plaintiff dated 26th July, 2019, which mentions the name of Pranab Kumar Maity as the company Secretary and DGM- Legal of the plaintiff. Mr. V. V. V Sastry, who was the recipient of the e-mail dated 13th October, 2020, is the Advocate-on-record of the plaintiff. The defendant nos.1 and 3 are represented in Court. In view of the submissions made on behalf of the parties and the communication on record, the application being GA/4/2021 is allowed. CS/211/2008 is dismissed as withdrawn for non-prosecution. Interim orders, if any, are vacated.
