The Court :- The testator was a bachelor during his life time. The mother of testator pre-deceased him. The only heir in intestacy as indicated in the petition is the sister who qualifies under Class-II heir as per the provisions of Section 8 read with schedule under the Hindu Succession Act, 1956. The said sister has consented to the grant.

Considering the view of the department upon complete scrutiny, let probate of the last Will and Testament dated 3rd February, 2021 left behind by the deceased be granted in terms of prayer [a] of the petition.
