...for respondent no. 3 The Court: Heard learned counsel appearing for the parties. By this writ petition, petitioner has made a very innocuous prayer or direction upon the Additional Commissioner of Customs/respondent no. 2 for consideration of his representation dated 26th July, 2022 being annexure P-2 to the writ petition. Considering the submissions of the parties, this writ petition being WPO 2603 of 2022 is disposed of by directing the respondent no. 2 to consider and dispose of the aforesaid representation of the petitioner being annexure P-2 to the writ petition in accordance with

law and by passing a reasoned and speaking order and after giving opportunity of hearing to the petitioner or his authorised representative within eight weeks from the date of communication of this order.

Mr. Dey, learned counsel appearing for the respondent DRI submits that an investigation is pending against the petitioner in which he is not co-operating. Petitioner must co-operate with the investigation proceeding in question and respond to the summons if issued in course of the investigation proceeding and in case of noncompliance, Authorities will be entitled to take action against the petitioner in accordance with law.

With this observation and direction, this writ petition stands disposed of.
